The purpose of this Legal Notice (hereinafter, the “CONDITIONS“) is to regulate the access and general use of the portal http://www. carboneria.es (hereinafter, the “WEBSITE“), to establish the rights and obligations of each party, as well as the different contents and services provided by LESING LWP SPAIN S.L.U. or by third parties from and/or through it.

1. OWNERSHIP AND DEFINITIONS

1.1. This Website is managed by the company LESING LWP SPAIN S.L.U. (hereinafter, “LESING LWP“), with Tax Identification Code B-66825563, registered office at Av. 1.2. For the purposes of these Terms, the term “Lesing LWP” or “We” refers to the Owner of the Website, identified in the previous section. The term “You”, “User” or “Users” refers to any person who accesses, browses and otherwise uses the Website, its content and / or services.

1.3. The effective date from which the Conditions shall apply shall be as set out at the end of this document. 

2. USE OF THE WEBSITE

Lesing LWP, through the Website, provides access to certain information and content, made available to the User directly by us or by third parties, and in particular, provides information on residential units that it promotes and markets, in addition to the property where they are located.

2.2. The User agrees to use the Website and the content and or services offered on it in accordance with these Conditions and other notices, use regulations or instructions brought to their knowledge, diligently and correctly, pledging not to use it for illegal purposes or effects prohibited in these conditions or harmful to rights or interests of Lesing LWP or third parties, infringing the regulations on intellectual and industrial property, or any other rules of applicable law, or perform any action that could disable, overburden or damage systems, equipment, servers or services of the Website accessible directly or indirectly through it.

3. DISCLAIMER OF WARRANTIES AND LIABILITY

3.1 Lesing LWP tries by all technical means possible that the Website is always available, operational and in optimal operation. However, sometimes, given the nature of the digital environment, incidents beyond our control may occur that prevent the use, access and / or navigation through the Website. When reasonably possible, Lesing LWP will give prior notice of interruptions in the operation of the Website and services. Lesing LWP does not guarantee the usefulness of the Website and the services for the performance of any particular activity, nor its infallibility and, in particular, but not exclusively, that users can actually use the Website and the Services, access the various web pages that make up the Website or those from which the services are provided.

Lesing LWP excludes, to the fullest extent permitted by law, any liability for damages of any kind that may be due to lack of availability, access failures, operability and continuity of the operation of the Website and services.

3.2. Lesing LWP has taken all necessary measures permitted by current technology to ensure and prevent the existence or transmission of viruses and or any other harmful software through the Website.

Lesing LWP assumes no responsibility nor can it guarantee the absence of viruses or other similar elements on the Website and or the server on which it is hosted. Lesing LWP excludes, to the full extent permitted by law, any liability for damages of any kind that may be due to the presence of viruses or the presence of other elements in the content that may cause alterations in the computer system, electronic documents or files of users.

3.3. Lesing LWP may at any time, at its sole discretion and without any obligation of prior notice, permanently suspend the presence of the Website on the Network and, therefore, of the services provided from or through this. When reasonably possible, Lesing LWP will give prior notice of the termination or suspension of the provision of the Website service. Lesing LWP is exempt from any liability for the consequences that may arise from the permanent suspension in the provision of such services.

3.4. The graphic representations of plans included on the website are intended to verify whether the space is suitable for the intended purpose, and are without binding or contractual character. Their purpose is to present the structure, installations and distribution of elements in the residential units and the property itself in an illustrative manner. The graphic representations of the plans do not form part of the commercial offer, promotion or invitation to purchase. All pre-contractual information required by the applicable regulations in force shall be duly provided by the seller prior to the conclusion of the purchase contract. The information corresponding to the plans may be modified in accordance with the technical and/or legal requirements in each case, and the complementary elements and their distribution, such as kitchen, bathroom or garden furniture and installations, among others, are shown for illustrative purposes only, and do not form part of our offer and/or promotion.

3.5. The content and information on the Website has been thoroughly reviewed in order to present the User with adequate, transparent and up-to-date information. However, we reserve the right to change any content that may need to be corrected or updated.

4. INDUSTRIAL AND INTELLECTUAL PROPERTY RIGHTS

4.1. The intellectual and industrial property rights of the contents, including text, corporate logos, trademarks, designs, illustrations, images, guides, source code and any element of the Website, are the exclusive property of Lesing LWP and, where appropriate, of the entities or persons expressly indicated, being all protected by the Spanish legal system and the Community and international standards that may be applicable. 

4.2. The contents and elements of the Website are the intellectual property of Lesing LWP or third parties, without being transferred to the User, being expressly prohibited the reproduction, processing, distribution, public communication, making available, extraction, reuse, reposting or use of any nature, by any means or process, any of them, except where legally permitted or authorized by the owner of the corresponding rights.

4.3. The User may view and obtain a temporary private copy of the Contents for his or her exclusive personal, private and non-collective use on his or her computer systems (software and hardware), provided that it is not for the purpose of developing collective activities or of a commercial or professional nature.

5. APPLICABLE LEGISLATION

Without prejudice to the rights that correspond to the User who is a consumer in accordance with mandatory regulations, this legal notice and its conditions are governed by Spanish law.
